The Supreme Court's ruling and the arrested Congress leader Pawan Khera

 The Supreme Court issued notice to the states of Uttar Pradesh and Assam, where FIRs have been filed against Pawan khera,



 on Khera's petition seeking their consolidation. This was in addition to the Supreme Court's order that Pawan Khera be granted interim bail.Senior Congress leader Pawan Khera was arrested by the Assam Police earlier in the day from the Delhi airport. On Thursday, the Supreme Court directed a court in Dwarka to grant interim bail. For his remarks at a press conference that he made about PM Modi, an FIR had been filed against Khera.

“In order to protect the petitioner until such date as he applies for regular bail before the jurisdictional court upon the FIRs being transferred to one and the same jurisdiction, we direct that until the next date of listing, the petitioner shall be released on interim bail by the court of the competent magistrate in Delhi where he is to be produced this evening,” the Supreme Court bench of Chief Justice of India DY Chandrachud, Justice PS Narasimha, and Justice MR Shah stated. The preceding order will remain in effect until Tuesday.

Under what law was Pawan Khera arrested?

Khera referred to the Prime Minister as "Narendra Gautamdas Modi" at a recent press conference in Delhi to demand an investigation into the Gautam Adani Group by a joint parliamentary committee (JPC).

The Congress leader was then confronted by a BJP member in Assam named Samuel Changsan, and on Wednesday, an FIR was filed at the Dima Hasao police station in Haflong.

Sections 120 B (criminal conspiracy), 153 A, and 153 B (m (promoting hostility based on religion, race, or place of birth, among other factors) were the charges against Khera. The Indian Penal Code contains sections 500 (defamation), 504 (intentional insult with intent to provoke breach of the peace), and 505  and  (statements conducive to public mischief).Complaints against him have also been filed in Uttar Pradesh.

Narendra Damodardas Modi is the PM's full name, and his father's middle name is Modi. “I genuinely got confused whether it is Damodardas or Gautam Das...” was the tweet that Khera sent out on February 17.

What also transpired in the Supreme Court?

The Supreme Court also issued notice to the states of Uttar Pradesh and Assam, where FIRs have been filed against Khera, regarding his petition for their consolidation, in addition to directing Khera to be granted interim bail.

“We are inclined to consider the plea confined to the question of whether or not the FIR should be clubbed. In the case of Arnab Ranjan Goswami, this course of action was taken. We also agree that the spoken words do not, on their own, lead to the sections mentioned in the FIR. As a result, we direct the prayer to be transferred and all FIRs filed against Khera to be merged. As reported by Bar and Bench, the order stated, "Notice to Assam and State of UP."

Senior Advocate AS Singhvi appeared on behalf of Khera and informed the court that the defendant had expressed regret and claimed that the remarks were a "slip of tongue."

Even though Singhvi disagrees with the comments, they "should not lead to arrest," he stated.

Assam's Additional Solicitor General, Aishwarya Bhati, presented a video of Khera's press conference to the Bench, claiming that the Congress leader's "demenour" demonstrated his intention.

"This statement is made with the intention of removing public discourse and inciting public discontent. It is directed against the country's legitimately elected Prime Minister. According to Bar and Bench, Bhati stated, "It is deliberate and calculated."

Is Pawan Khera real?

Khera began his political career as a Youth Congress activist in Udaipur in the 1980s. He worked for Sheila Dikshit, the late Delhi Chief Minister, as a key aide since 1998.

Around 2018, Khera became the Congress's television face, arguing the party's position vehemently and aggressively. He was made national spokesperson in 2018. While he was not considered for a seat in the Rajya Sabha last year, the Congress appointed him as Chairman of the Department of Media & Publicity.
